Significant New OHS Penalties and how to prepare.
The Victorian Parliament recently passed new workplace manslaughter laws that will impose fines and jail terms for employers responsible for negligently causing death.
The Victorian Workplace Safety Legislation Amendment (Workplace Manslaughter and Other Matters) Bill 2019 includes fines of up to 100,000 penalty units currently equating to $16,522,000 for bodies corporate, and potential jail terms of currently up to 25 years for corporate ‘officers’ and other senior staff.
In order to guide business on how to prepare for these new laws, the Victorian Chamber of Commerce and Industry has developed a range of fact sheets, webinars, vignettes and other online resources from our health, safety and wellbeing experts and policy team on how employers can better prepare and respond to these new laws commencing on 1 July 2020.
Is your business at risk?
Although these laws will not impose any new OHS duties on business, the threat of significantly increased penalties should motivate all businesses to review and ensure they have robust OHS practices and procedures in place that comply with their OHS obligations.
The Victorian Chamber has developed an online diagnostic tool which is based on the 5-step approach we would encourage all businesses to follow in reviewing and documenting high risk activities, hazards and controls.
